MyChart Terms of Use

Franciscan Alliance Information Services (“FAIS”) has provided website and internet-based services to your provider (“Provider”), offering a secure and private channel for Provider and healthcare communications. This platform is called MyChart®, and it includes personal medical information storage, online healthcare information, billing, and related products, services, and content. Your Provider is making MyChart® available to you in accordance with the terms and conditions set forth herein (“Terms of Use”).

Terms of Use.  MyChart® is offered to you under the terms and conditions listed in this Terms of Use agreement.    MyChart® is available to patients and individuals involved in the care of patients as approved proxies. FAIS reserves the right to update or change these Terms of Use at any time and for any reason by posting the modified Terms of Use.  Your continued use of MyChart® constitutes your acceptance of any revisions and you should therefore periodically visit this page of the website and print the latest version of the Terms of Use for your records.  The date of the last update to these Terms of Use is stated at the top of this document.

Cost.  There is no charge for general access and usage of MyChart.  Utilization of certain features may incur a cost and there will be a notice of acceptance of any charge prior to usage.

Use of ServicesTHE USE OF MYCHART® IS NOT INTENDED FOR MEDICAL EMERGENCIES.   IF YOU ARE EXPERIENCING CHEST DISCOMFORT, SHORTNESS OF BREATH, EXCESSIVE BLEEDING, OR ANY OTHER LIFE-THREATENING EMERGENCY, CALL 911 IMMEDIATELY.

Appointments.  MyChart® offers you the ability to submit an electronic request for an appointment with your Provider.  You are able to provide available dates, times and location that are best for you.  Your Provider will respond to your appointment request as soon as reasonably practicable.

Self-Scheduled Appointments.  MyChart® offers patients the ability to self-schedule appointments with certain Providers.  You are able to choose from a list of available dates and time slots for the selected clinic location and Provider.

Prescriptions.  You agree that any prescriptions that you acquire through MyChart® shall be solely for your personal use.  You agree to fully and carefully read all provided product information and labels and to contact your Provider if you have any questions regarding the prescription.

Educational Resources.  MyChart® may offer links to related medical websites not managed by FAIS.  These website link(s) are for informational purposes only.  FAIS may make available self-care informational services, which provide general medical and health information.  These communications and resources are for general educational and informational purposes only and should not be relied upon as a substitute for patient-specific medical diagnosis and treatment.  These resources are not a substitute for seeing an appropriate healthcare professional for medical treatment. In no event shall Franciscan Alliance or its affiliates, partners, or content suppliers be liable for any indirect, incidental, special, punitive, or consequential damages arising from or related to your use of this educational material, the content, or any other education resources.

Response to Electronic Communication.  Your Provider will use good faith efforts to provide a timely response to electronic inquiries.  In some cases, Providers or their staff members who respond to electronic inquiries or other communications may not be immediately available, so please do not use MyChart® to request information or services for which a timely response is required.  Emergency situations and those requiring immediate medical attention should not be submitted electronically.  Communications via MyChart must only reference your care and no other individual’s care.  See the Proxy Access section for information pertaining to communication referencing other patients.

Photos.  You or your Provider may submit a photo of you as a “profile photo” for identification purposes.  This profile photo may be attached to your MyChart® Account and may be attached to the demographic section of your Electronic Medical Record.  Appropriate picture criteria:

⦁          Directly facing front with full face in view.

⦁          Well-lit and clearly displays face.

⦁          Should represent current appearance – recent photo.

⦁          Does not include multiple people.

Photos submitted for treatment purposes will become part of your Medical Record.

Medical Disclaimers.  You and your Provider are exclusively responsible for all information and/or communication through the MyChart® service.  Furthermore, your Provider’s appropriate response to communication from you is contingent upon the specificity of the information provided by you to your Provider.  Your Provider is able to respond to such communications based on only the information provided by you.  If you provide insufficient information, your Provider will be unable to provide a timely and complete response.  You agree to contact your Provider immediately should your condition change or your symptoms worsen. MyChart should never be used for emergencies or urgent needs. If you are experiencing an emergent or urgent condition, you should contact your local emergency services immediately.

Most test results are now available to you and your Provider at the same time.  This means you might review your test results before your Provider has had the chance to see them.  As always, if you have questions about any particular test, please contact your Provider’s office.

Occasionally, test results contain sensitive or alarming information.  In many instances your Provider may have anticipated this and discussed such possible results when the test was ordered.  Other times, these results may be unexpected.  You can decide whether to review test results immediately, or wait to do so until you are able to do so together with your Provider.

Medical Record.  Your MyChart® Record is created to store your personal health (including health conditions, allergies, clinical notes, medications, immunizations, and test results) and billing information online.  You agree to provide accurate information for your MyChart® Record, to periodically review such information and to update such information as needed.  For additional information regarding use of your MyChart® Record, please see the MyChart® Privacy Policy.  You may authorize another person (such as a family member) to access your MyChart® Record and access shall be granted following the terms outlined in the Proxy Access section below in this Terms of Use.

Health Information from other Organizations.  You may see information in your MyChart® Record from all health organizations and Providers utilizing Epic’s electronic health record system from which you’ve received care, even if you don’t have an active MyChart® account at each one.  Medications, allergies, and health issues from all organizations and Providers appear together to give you (and your Providers) a more complete picture of your healthcare.  If you have an active MyChart® account at other organizations, you also may see test results, messages, and appointments in a combined view and take follow-up actions, such as sending messages, without having to log in to a different account.  Displaying medications, allergies, and health issues from non-Epic organizations is not yet supported.

Before you can see information from other healthcare organizations and providers, when you login to your MyChart® Record, you must connect your accounts and consent to your Provider accessing your data from other organizations and providers.  Only organizations and Providers that have shared or received information about you through Care Everywhere appear in the list of organizations to connect.  You may go to “Settings > Manage My Accounts” to unlink any connected accounts or link to additional accounts at any time.

PLEASE NOTE: The filtering of data for display (or not) is controlled by FAIS for your Provider, and by the organization that provides the underlying Epic electronic health record to your other providers.  Also, the decision of whether to utilize certain MyChart® security features and/or security for proxy access is controlled by the organization whose MyChart® site the patient is logged in to.  For questions about data displayed or excluded from MyChart®, please contact the respective health organization associated with that information for assistance.

Online Credit Card Payments.  MyChart® includes an on-line bill payment service for Franciscan Alliance, Inc., and Specialty Physician of Illinois, LLC (“Franciscan Billing Services”) (“Online Bill Payment Service”).  This Online Bill Payment Service is an option made available as a convenience to you pursuant to the terms below.  If you prefer not to use this Online Credit Card Payment Service, or if you do not accept the terms below, traditional billing payment remains available to you by contacting Franciscan Alliance Customer Service at 1-866-903-0436.

 

We process credit card payments for payment of services from within MyChart. You can pay in full for services or you can sign up for a payment plan. We have the following practices:

  • For payment plans, you can choose your payment terms (e.g., monthly amount and payment withdraw date) as long as they fall within the established payment plan guidelines.
  • You can add a credit card and we will ask for the card type, card number, expiration date, card security code, and your card’s billing address.
  • We will transmit credit card numbers in an encrypted format using industry-standard encryption.
  • When a credit card transaction is validated we will tokenize it, or replace the primary account number with an alternate value, to avoid storage of your credit card information in our computer system. This token is used to make future payments from the MyChart system.
  • We will make every effort to maintain the privacy and security of the information at all times.
  • Refunds on credit cards will not be administered via this website. For refunds please contact Franciscan Alliance Customer Service at 1-866-903-0436 or send a Customer Service request through the MyChart system.

Franciscan Alliance will use all reasonable efforts to process all your payment authorizations promptly and properly, provided the authorizations are actually received by Franciscan Alliance. Franciscan Alliance will not be responsible for any failure to process a payment authorization that is not actually and completely received by Franciscan Alliance for any reason, including user error, equipment malfunction, natural disasters or impediments, or inaccurate or incomplete information.

Paperless Bill Delivery Services. MyChart® users will be automatically enrolled into paperless billing by default.  This authorizes the Provider and its licensors to provide and deliver billing documents electronically through MyChart® with electronic notifications as outlined in the Electronic Communication Disclosure Agreement section of this document. Such Services are referred to as Paperless Bill Delivery as part of this Agreement.

By accepting the terms for Paperless Bill Delivery, you agree that you (1) have selected to receive an electronic communication, (2) acknowledge that no paper document will be sent to you, and (3) have read and accepted the terms of the Electronic Communications Disclosure Agreement.

Payment Responsibility. You agree that you are responsible for the payment of charges even given the following circumstances:

  1. You opt out from the Paperless Bill Delivery Service.
  2. The electronic delivery was not received.
  3. You have changed Email address, Username, Password or any required information related to the success of the electronic delivery.
  4. Circumstances beyond our control prevent the proper electronic transmission of your Paperless Bill Delivery and the Provider has taken reasonable precautions to avoid those circumstances.

In addition to the above services, MyChart® can be used to access features which may have an additional cost:

E-Visits.  An E-Visit is a non-urgent visit with your Provider that would otherwise require an office visit.  You may initiate an e-visit in which you answer questions based upon your general symptoms and/or conditions for assessment by your Provider.  Any information provided as part of an E-Visit becomes part of your Medical Record.    You are responsible for these fees and/or copayment charges and agree that your Provider may charge you for E-Visits.

Video Visits.  MyChart® offers a secure channel to conduct scheduled video visits with your Provider through your personal computer, smartphone or mobile device.  Personal health information may be shared during the video visit; thus, you should be aware of your personal environment to ensure privacy.  If your health insurance coverage does not cover video visits, you will be responsible for any applicable fees.  You are responsible for these fees and/or copayment charges and agree that your Provider may charge you for video visits.  Reliable internet connectivity is required to conduct video visits.

MyChart® Share Everywhere.  Share Everywhere provides a way for you to share portions of your medical record with others of your own choosing. You may share your medication lists, allergies, health issues and immunization records with third parties on a temporary basis. These third parties then have the capability to message your primary care provider until their access expires. Messages sent through Share Everywhere may not be reviewed by your Provider, will not become part of your medical record, and do not constitute a referral. Share Everywhere is not intended to communicate urgent or emergent needs, you or the third parties you share with should call 911 in the event of an emergency. Further, any correspondence intended for a Provider should be delivered by traditional means (fax, letter, or phone).

 

Account Management/Eligibility.  The following individuals are eligible to access MyChart®:

  1. An individual 18 years or older;
  2. A medically emancipated minor;
  3. A legally emancipated minor;
  4. A minor between the ages of 12 and 18 with a parent or legal guardian’s permission, and who grants a mutual right of access to the minor’s parent or legal guardian.

FAIS reserves the right to modify its MyChart® permission or access to features based upon patient age, repeated disruptive and/or noncompliant behavior in accordance with its organizational policies.

Your Account.  In making a request for an individual MyChart® account, you represent and warrant that you possess the legal right and ability to enter into these Terms of Use, to register on MyChart® under your own name, and to use MyChart® in accordance with these Terms of Use and abide by the obligations hereunder.  You are solely responsible for maintaining the confidentiality of your password, and for all activities that occur under your password.  You agree to prohibit anyone else from using your password and immediately notify your Provider of any unauthorized use of your password or other security concerns of which you become aware.

Proxy Access.  Proxy Access in MyChart® allows an authorized person (“Proxy”) to access another person’s MyChart® Record (medical and billing information).  Typically, parents, Health Care Representatives or Powers of Attorney for Health Care will serve as a Proxy to access the MyChart® Records of those they care for.  Requests for proxy access may be made in-person to your Provider or the Franciscan Alliance Health Information Management (HIM) Department.

Proxy access also grants the ability to send secure messages on behalf of the patient through their own medical record.  MyChart Communications related to the patient must be conducted through the patient’s MyChart account via proxy access and NOT using the proxy’s own MyChart account.

  • Minor Patients ages 0-11 (Children): Parents and legal guardians of minor patients between the ages of 0 and 11 are eligible to access a MyChart® Record on behalf of such child, and to participate in the full spectrum of MyChart® services on behalf of the child.  Proxy Access to a child’s MyChart® Record will be granted only to parties with parental rights or legal guardianship over the minor patient, and only to the extent that the party requesting proxy access can demonstrate the legal right to the child’s medical information.

 

  • Minor Patients ages 12-17 (Adolescents): Parents and legal guardians of minor patients between the ages of 12 and 18 may permit the adolescent to have access to the adolescent’s MyChart® Record.  Under State and Federal law, there are certain services and procedures that adolescents aged 12 or older can consent to on their own behalf, but others for which parental consent is required.  Because of these requirements, Providers may not share certain information about an adolescent patient with their parent or guardian without the adolescent’s permission; and similarly may not share other information with the adolescent without their parent’s or guardian’s permission.  To permit robust reporting through the MyChart® Record to all who are allowed access, neither FAIS nor providers of services to adolescent patients who use the Epic Medical Record system will permit an adolescent to have access to their MyChart® Record unless the parent or legal guardian permits access to such MyChart Record.  Similarly, parents and legal guardians of adolescent patients will not be granted full access to the MyChart® Record of an adolescent patient unless the adolescent agrees to share the adolescent’s full MyChart® Record with the parent or guardian.

 

  • Adult Patients: Individuals age 18 or older may authorize proxy access to their MyChart® Record to another individual.  An adult patient may make the request in-person to the Patient’s Provider or to the Franciscan Alliance Health Information Management Department.  The adult patient must provide the proxy’s full name, date of birth, home address, phone number and email address.  The Patient’s MyChart® Record will be made available to the proxy.  The adult patient may revoke the proxy’s permission to their MyChart® Record at any time from within MyChart.  FAIS reserves the right to revoke proxy access at any time for any reason.

 

  • Non-Decisional/Incapacitated Patients: Proxies of non-decisional/incapacitated patients are eligible to participate in the full spectrum of MyChart® services on behalf of the non-decisional/incapacitated patient.  If a Physician determines a patient does not have decisional capacity, an appropriate surrogate (i.e., Power of Attorney for Health Care, Health Care Representative or other legally appropriate surrogate) may request and be granted permission to access to the patient’s MyChart®  A Court Ordered Legal Guardian must present a copy of legal paperwork verifying their authority to have access to the Patient’s medical information.  After providing the appropriate paperwork, the legal guardian may request to be granted permission to full functionality (i.e., to view and act on behalf of the patient) within their MyChart® Record.

Temporary Suspension of Access.  FAIS may temporarily suspend access to the MyChart® Record for administrative reasons.  If you need access to medical record information during these times, please contact your health care Provider’s office directly.  For emergencies, go directly to an emergency room or call 911.

Termination of Access Upon Death:

A patient’s access to MyChart® will be deactivated upon notification of the patient’s death.  Existing proxies will have access to the decedent’s chart for 3650 days.  Request for access to a deceased patient’s records can be made through their provider, however additional proxy access will not be granted.

E-mail/SMS Text Privacy.  In order to activate your MyChart® Record, you must provide your Provider with an email and/or SMS text address.  Once you have an account, MyChart® will notify you via e-mail or SMS text when new medical information is available for viewing within your MyChart® account.  This means that any person with access to your e-mail or SMS text will be able to see this notification.  This could include your spouse, employer or anyone else who can access your e-mail or SMS text account.  Although no private medical information will be sent, the notification that new medical information is available by accessing your MyChart® Record may be information that you would not want others to know.  Thus, you should take this into account when providing an e-mail or SMS text address.  By enrolling in MyChart® and requesting email or SMS text communications, you consent to receive electronic communications as outlined in the Electronic Communications Disclosure section of this document.

While communications made through MyChart® are encrypted and generally secure, you understand that e-mail and SMS text messages outside of MyChart® are not encrypted and are not a confidential means of communication.  Thus, if you choose to communicate with the Practice through any means outside of MyChart®, you agree to waive any rights that you may have against your Provider, FAIS (as the host of your Provider’s MyChart® Record service), and the supplier or operator of MyChart®, for any loss of information due to technical failures and/or unintended breach of confidentiality or unauthorized access to your information.

If you send your Provider any messages through MyChart®, it may be shared with your Provider’s staff who assists your Provider in providing medical care, including appropriate clinical staff.  Messages you send via MyChart® may become a part of your medical record and may be accessible to your current and future Providers and their staff members who are involved in your care. You should not discuss any other patient’s care from your own MyChart®.  If you have proxy access, you can message the provider on their behalf through their MyChart® account.

Franciscan HealthConnect.  Your Provider licenses its MyChart® system from FAIS, a division of Franciscan Alliance, Inc, through a program called Franciscan HealthConnect (“HealthConnect”).  FAIS may require access to your MyChart® Record as necessary to address technical issues.  FAIS will not use or disclose individually identifiable information except as necessary to review and resolve such technical issues.

FAIS Security and Confidentiality.  FAIS affords the same degree of confidentiality to medical and billing information stored on MyChart® as is given to medical and billing information stored by FAIS in any other medium.  FAIS is committed to protecting the confidentiality of your medical and billing information.  FAIS limits its employees’ access and ability to enter or view information based upon their role in your care.   Firewalls, passwords, encryption, and audit trails are further used to safeguard your information.  FAIS has taken steps to make all information received from our online visitors as secure as possible against unauthorized access and use.

For other than general information viewing, MyChart® must be accessed with a Secure Sockets Layer (SSL) compatible browser or terminal (use most up-to-date web browser version of Internet Explorer, FireFox, Chrome, Opera or Safari).  FAIS’s SSL web server uses authentication and supports the highest level of encryption supported by your browser.

You can tell when you are secure by looking at the location (URL) field.  If the URL begins with https:// (instead of http://), the document comes from a secure server.  This means your data cannot be read or deciphered by unauthorized individuals.  You can tell whether you are truly connected to your Provider by viewing the digital certificate.  This certificate verifies the connection between the host, FAIS, the server’s public key and the server’s identification.

User names and passwords provide two layers of authentication and are stored by FAIS in an encrypted database that is isolated from the Internet.  As a MyChart® user, your role in maintaining the security of your medical information is: (1) Changing your password on a regular basis, and (2) Keeping your login ID and password confidential.

Minimum Requirements and Patient Security. While you may be able to access and retain the Communications using other hardware and software, we currently support the following minimum requirements:

  • A personal computer equipped with an Internet browser that has 128-bit encryption enabled and configured to accept cookies (e.g., Internet Explorer 7 or 8, Safari, or Firefox; Internet Explorer 6 may not allow you to view some materials, such as test results); and
  • Internet access, a valid email account, software to receive and read email messages, and spam filters set to accept email from our domain.

Most Communications provided within our websites are provided either in HTML and/or PDF format. For Communications provided in PDF format, Adobe Reader 6.0 or later versions is required – a free copy of Adobe Reader may be obtained from the Adobe website at www.adobe.com. In certain circumstances, some Communications may be provided by email. You are responsible for providing us with a valid email address to accept delivery of Communications. At our option, we may also post the emailed Communications within our websites. In this situation, you agree that once we email the Communications to you and post them within our websites, including through the MyChart system, that we have delivered the Communications to you in a form that you can access and retain. To print or download Communications you must have a printer connected to your device or sufficient hard-drive or other storage space to store the Communications.

Links to Third Party Sites.  MyChart® contains links to websites operated by other parties.  The links are provided for your convenience only.  Neither FAIS nor your Provider controls such websites and neither FAIS nor your Provider is responsible for the content and performance of these sites.  The inclusion of links to other websites does not imply any endorsement of the material on the websites or any association with their operators.  Neither FAIS nor your Provider operates, controls, or endorses any information, products, or services provided by third parties through the Internet.  Use of other sites is strictly at your own risk including, but not limited to, any risks associated with destructive viruses.  You are responsible for viewing and abiding by the terms and conditions of use and the privacy statements of the other websites.

Legal Notices and Disclaimers.  You acknowledge that your use of MyChart® is at your sole risk, and that you assume full responsibility for all risk associated therewith.

Privacy.  FAIS and your Provider respect your privacy and take privacy very seriously.  By accepting this Terms of Use, you consent to the use and disclosure of personally identifiable information provided to FAIS and your Provider as outlined in the MyChart® Privacy Policy, which is incorporated herein by reference.

Connection to Apple Health Kit, Other Devices and Applications.  With your permission, certain versions of MyChart® can connect to Apple HealthKit and other connected devices to receive requested health information your Provider ordered and to share that information with your healthcare Providers.  Neither FAIS nor your Provider will share your health information with Apple HealthKit or with other supported software.  Sharing will occur only if you give your permission when you link your Apple HealthKit and other connected devices to your MyChart® Record.  Please note that your information will not be reviewed immediately by your physicianIf you are concerned with your reading please call your Provider immediatelyThis is not an appropriate method to communicate urgent information.

Neither FAIS nor your Provider manages or controls the security and privacy of Apple HealthKit, other devices and applications.  It is your responsibility to determine whether Apple HealthKit, other devices and applications meet your security and privacy needs, and you should determine how these sites secure your data prior to granting permission.

You can go to “Settings > Linked Apps and Devices” to view and link or unlink any connected devices or applications at any time.

 

General Legal Provisions; Operation and Record Retention.  FAIS reserves complete and sole discretion with respect to the operation of MyChart®.  FAIS may, among other things, withdraw, suspend or discontinue any functionality or feature of MyChart®.  FAIS is not responsible for transmission errors or corruption or compromise of data carried over local or interchange telecommunication carriers.  FAIS is not responsible for maintaining data arising from use of MyChart®.  FAIS and/or your Provider reserve the right to maintain, delete or destroy all communications and materials posted or uploaded to the MyChart® pursuant to its internal record retention and/or destruction policies.

Limitations on Use.  You agree not to access or use MyChart® in an unlawful way or for any unlawful purpose.  You may send e-mails to other parties solely for personal communication and no other purposes, including commercial purposes, or for mass distributions of unsolicited e-mails.  You agree not to post or transmit: (a) a message under a false name; or (b) any information which (i) is libelous, defamatory, obscene, fraudulent, false or contrary to the ownership or intellectual property rights of any other person, or (ii) contains any virus, worm, Trojan horse or other code which is contaminating or destructive to the files or programs of FAIS, your Provider or any of their respective users. FAIS reserves the right to delete any information provided by you that it deems in its sole discretion to be fraudulent, abusive, defamatory, obscene, in violation of a copyright, trademark, other intellectual property or ownership right of any other person.

Term and Termination.  These Terms of Use shall commence upon the date you first access or use MyChart® and/or complete the registration process.  FAIS may terminate these Terms of Use and either FAIS or your Provider may terminate your right to use MyChart® at any time, with or without cause.  These Terms of Use and the licenses granted hereunder shall terminate without notice in the event you (or any authorized person using your account) fails to comply with these Terms of Use, or any rules for use of MyChart® promulgated by your Provider from time to time.  Upon any termination, you will destroy all copies of any MyChart® materials in your possession and cease any access to or use of MyChart®.

 

Electronic Communications Disclosure

Please read this Electronic Communications Disclosure (“Disclosure”) thoroughly –  it contains important information about your legal rights.

Your Rights. Certain laws and regulations require us to provide specific information to you in writing, which means you have a right to receive that information on paper. We may provide such information to you electronically if we first present this Disclosure and obtain your consent to receive the information electronically. Your consent will also apply to any other person named on your account, subject to applicable law. Since certain documentation associated with your patient account is provided online and we may use electronic means to deliver some of this information, you must consent to this Disclosure in order to use these services. At times, we may still send you paper communications, but as a basic proposition we need to know that you are willing to receive communications electronically that we may otherwise be required to provide on paper and that you have the hardware and software needed to access to this information (and note that in the Setting Your Electronic Communications Preferences section below, we explain ways to obtain selected disclosures or other information on paper even after you have consented to this Disclosure).

Types of Electronic Communications You Will Receive. You understand and agree that we may provide to you in electronic format only, by posting the information through the MyChart® system, through email (if applicable and if you have provided a valid email address), or other electronic means, agreements, disclosures, notices, and other information and communications regarding your patient account (“Communications”). Such Communications may include, but are not limited to:

  • This Disclosure and any updates;
  • Disclosures, agreements, notices and other information related to your patient account including, but not limited to, account agreements, payment plans or other disclosures or notices that may be required by applicable federal or state laws and regulations;
  • Periodic, annual, monthly or other statements, disclosures and notice relating to the maintenance or operation of an account, product or services associated with through the MyChart® system, or other statements, disclosures or notices that may be required by applicable federal or state laws and regulations;
  • Any notice of the addition of new terms and conditions or the deletion or amendment of existing terms and conditions applicable to your patient accounts;
  • Our Privacy Statement and other notices (by posting such notices on our website);
  • Certain information or forms that we request from you and ask you to submit electronically, such as new patient documentation, health history questionnaires, or other pertinent documentation;
  • Medical forms related to or in anticipation of a medical appointment; and
  • Acknowledgment of certain policies that we request from you and ask you to submit electronically.

Setting Your Electronic Communications Preferences. After you consent to this Disclosure, you will receive all categories of Communications, except those referenced in the Types of Communications You Will Receive in Paper and Consent Coverage; Certain Notices From You Are Not Covered sections below, in electronic format only. You understand that to access these Communications you are responsible for creating and maintaining an account in the MyChart system. If you do not have a MyChart account, you can access these forms by contacting your provider’s office and requesting them. For more information on the availability of your electronic communications preference management options, please refer to MyChart, and once you have created an account, you can set and change your communication preferences through the MyChart system. If you do not have a MyChart account, you can speak to your provider about your communications preferences.

Types of Communications You Will Receive in Paper. This Disclosure does not apply to any communications that we determine, in our sole discretion, that we are required to deliver in paper form under applicable law or that you should receive in paper rather than electronic form. Such communications shall be mailed to the primary address we show for you in our records or otherwise delivered as required by law or the governing agreement.

Consent Coverage; Certain Notices From You Are Not Covered. Applicable law or contracts sometimes require you to give us “written” notices. You must still provide these notices to us on paper. Your consent here does not relate to those notices.

How to Withdraw Your Consent to this Disclosure. Subject to applicable law, you may withdraw your consent to this Disclosure by logging into your MyChart® account and reviewing your communication preferences under “my profile” and then “contact preferences”. If you do not have a MyChart® account, you can contact your provider to withdraw your consent to this Disclosure. Remember that you can always set your Communications preferences as described in the Setting Your Electronic Communications Preferences section above without withdrawing your consent to this Disclosure.

Obtaining Copies of Electronic Communications. You may print or make a copy of Communications by using the “Print” button (or otherwise using your printing functionality) or saving a copy – you should do this when you first review the Communications because after submission we do not necessarily keep them all in a place that you can access. Upon request, we will provide you with a paper copy of any Communications provided electronically by us to you pursuant to this Disclosure, provided we receive your request within 12 months after the date the Communication was first made available to you electronically. You may request a paper copy of these Communications by calling your provider. Be sure to specify the Communication for which you are requesting a paper copy, and the address to which it should be mailed. You may be charged fees for paper copies of the Communications.

Updating Your Contact Information. In the event that your email address or other contact information is changed, you must notify us of such changes immediately by logging into your MyChart® account and navigating to “my profile,” and then “contact information”. If you do not have a MyChart® account, please contact your provider to update your contact information, including your email address. If you fail to update or change an incorrect or invalid email address or other contact information, you understand and agree that any Communications shall nevertheless be deemed to have been provided to you if they were made available to you in electronic form on our websites, e-mailed to the email address we have for you in our records, or delivered through other electronic means.

Retain Copies for Your Records. We recommend that you print or download a copy of this Disclosure, the applicable service agreement and all other Communications, including our Privacy Statement to retain for your permanent records.

Notice.  FAIS may provide any notice required to be provided to you hereunder by e-mail to the e-mail address you provided to your Provider when registering for your MyChart® Record, by a general notice on the MyChart® Web site, or by written communication delivered by first class U.S. mail or express courier to your address on record in your MyChart® Record information.  You may provide notice to FAIS at any time by letter delivered by first class postage prepaid U.S. mail or overnight courier to Franciscan Alliance Information Services, 1500 Albany Street, Beech Grove, IN 46107.  Attn:  MyChart® Team.

By clicking “I Agree” or otherwise using MyChart®, you represent and warrant to us that you possess the legal right and ability to enter into these Terms of Use Agreement and to use the MyChart® services and agree to be solely responsible for your use of MyChart®.  By clicking “I Agree” or otherwise using MyChart®, you acknowledge that any previous consents given by you to FAIS or to your Provider will apply.
